The Subscriber must use the Website fairly, for lawful purposes only, and in a lawful manner.

Definitions: "User": an individual and/or a company or any other entity that uses the Website online via the Internet, including use of any of the services offered on the Website. "Website": the MyDocs website at https://mydocs.co.il

The Website administration developed the Website in order to facilitate the User’s work and will allow the User to use the Website for a limited period in accordance with the payment terms published on the Website.

The subscription may be purchased only for a certified notary, and the subscription is for a single notary.

The Website shall not be responsible for the issuance of any certificate/confirmation and/or for the safekeeping of the materials beyond hosting/storage.

Responsibility for reviewing and verifying any certificate/document rests solely with the Subscriber.

The Notary/Subscriber hereby confirms that they release the Website from any liability for any event, and acknowledges that the statutory duty under the Notaries Law to issue notarial certificates and to keep them applies to the Notary alone.

The Subscriber is required to provide accurate details as provided to the Ministry of Justice.

The Website may add services or change the Website’s structure; the Subscriber is aware of this and gives their prior written consent upon joining as a Subscriber to the Website.

Where necessary, the Website will use "cookies" to tailor browsing on the Website to the Subscriber’s needs, and the Subscriber hereby gives prior written consent upon joining as a Subscriber to the Website.

Use of the Website does not constitute legal advice and is not a substitute for such advice. The Website was built solely to assist the Notary in their work and does not relieve the Notary from checking the certificates/documents before issuing them.

The Website administration undertakes to use its best efforts to provide the Subscriber with continuous access to the Website to the extent possible, subject to limitations beyond the Website administration’s control.

Confidentiality and privacy of the Subscriber: the Website and the Website administration are obligated to keep confidential any information to which they are exposed and not to transfer it to any person or entity. The Website administration will keep Subscribers’ names and privacy confidential and will maintain full confidentiality of all information uploaded by the Subscriber to the Website and stored on the Website.

The Website administration hereby undertakes not to transfer any information in its possession to any other person and not to make any use of it in any manner whatsoever, unless the Subscriber instructs the Website administration otherwise, or only subject to a court order or as required by the Supervisor of Notaries at the Ministry of Justice.

The Website administration is not obligated to retain the information for more than 7 years. Website outages may occur since the Website is hosted by external hosting providers; the Subscriber is aware of this and releases the Website administration from any liability for any damage that may be caused to the Subscriber and/or their clients as a result of loss of materials or temporary lack of access to the Website.

The Subscriber must keep the login and access details to the Website in a secure and confidential place and releases the Website administration from any damage that may be caused if the Website access details are disclosed to a third party. In such a case, the Website administration shall be released from any liability toward the Subscriber and/or anyone on their behalf.

The Website administration shall not be liable for any damage of any kind, indirect or direct, that may be caused to the Subscriber or anyone on their behalf, inter alia, if and to the extent that content from the Website is lost or reaches a hostile party and/or is used without authorization. The Website administration will not disclose any information stored by the Subscriber on the Website and will not transfer the Subscriber’s details or their clients’ details to any party, nor disclose any such information, except where it is required by law; this exception includes the credit-card clearing/processing company and/or the Company’s suppliers directly connected with the Website’s activity and/or required for the Website’s operation and for retaining the information stored therein. The Subscriber thereby releases the Website administration from any liability for safeguarding such information.

Copyright

All intellectual property rights, including copyrights, designs, methods, and trade secrets on the Website, belong exclusively to the Website administration.

It is prohibited to copy, reproduce, distribute, sell, market, or translate any information from the Website, images, texts, and the like, without the Website administration’s prior written permission. You may contact the Website administration at support@mydocs.co.il.

It is prohibited to use any data/information appearing on the Website for the purpose of displaying/selling it on another website that does not belong to the Website administration, without the Website administration’s prior written consent.

It is prohibited to run any harmful application, including malicious software, to slow down the Website’s operation or harm the Website and/or bring it down, and it is prohibited to use a PROXY in relation to the Website.

Every visitor/subscriber/user, etc., is aware that the text on the Website, the graphics, the content, the software, the idea, and the Website are protected under copyright law. Any unlawful copying of the services constitutes copyright infringement and may result in the user being liable for damages; such conduct may also constitute a criminal offense under copyright law.

The User is aware that the Website administration may at any time add additional products or remove existing services; the User confirms that this is known to them and releases the Website administration from any liability in this regard.

The Website administration may amend the Website’s terms of use from time to time by means of bylaws/terms of use, at its discretion, and the binding version shall be the one published on the Website at the time of use.

If the Subscriber makes unfair or improper use of the Website and uploads large files that slow down the Website’s operation or uploads malicious software to the Website, the Website administration may delete such files without providing explanations. The Subscriber undertakes to use antivirus scanning before uploading content to the Website or to the digital archive.

The Digital Archive

The Subscriber/User undertakes to use the digital archive in accordance with the provisions of the Notaries Law.

Use of the archive is the User’s sole responsibility.

Use of the digital archive is carried out solely via a smart card, which the Notary purchases separately from an authorized certification authority.

Access to the digital archive is for the Notary only, and the Notary must keep the archive login details in a secure place and must keep the smart card (token) in their possession in a confidential place.

The Subscriber releases the Website administration from any liability regarding the operation of the digital archive.

The Website administration shall not be responsible in any manner for any harm that may be caused as a result of exposure to information and/or files and/or software uploaded to the Website or to the archive by a User/Subscriber; the exclusive responsibility shall be of the User who performed such upload.

Payment to the Website administration for use of the Website is for a limited period according to the subscription terms; the service the Subscriber receives is only as stated in the engagement terms.

The Website was built with careful thought to facilitate the Notary’s work, but mistakes may occur. The Website administration shall not be liable for any error found on the Website.

The Website is provided "AS IS". It is marketed in its current form and is not customized individually for each Subscriber/User, and the Subscriber accepts the Website’s terms of use.

It is hereby clarified that the Website administration is not liable for any damage/loss, loss of income, or loss of profit that may be caused to any person as a result of using the Website, and the User hereby agrees that the Website administration shall have no such liability and releases the Website administration in advance from any such liability.

The Website administration’s liability toward the Subscriber is limited to the subscription fees only.

The Website administration will do everything in its power to provide full access to the Website, but the User hereby declares that they are aware that the Website and its content are hosted on external servers and the Website administration has no control over this; disruptions may occur and their repair depends on external suppliers. Therefore, the User releases the Website administration from liability for providing continuous and uninterrupted service.

The Website administration welcomes you for joining its customer base and undertakes to provide a friendly user experience on the Website in order to facilitate its use.
